In consideration for participating in the photography session provided by Mountaintop Media, I, the undersigned Client, understand and agree to the following:

1. Assumption of Risk: I understand that participation in a photography session may involve certain inherent risks, including but not limited to movement, posing, and interaction with the environment. I voluntarily assume all such risks for me and my party.
2. Release of Liability: I hereby release, waive, and forever discharge Mountaintop Media, its owners, employees, agents, and representatives (collectively, “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any participating individuals during the photography session, whether caused by the negligence of the Released Parties or otherwise.   
3. Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all losses, liabilities, damages, costs, and expenses (including attorney’s fees) arising out of or related to any claims made by me or any participating individuals.   

Model Release:

For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I, the undersigned Client, hereby grant to Mountaintop Media, its licensees, successors, and assigns (collectively, “Grantee”) the irrevocable right and permission to copyright, use, re-use, publish, and republish photographic portraits or pictures of me and/or any minors under my legal guardianship participating in the photography session (collectively, the “Images”), in whole or in part, individually or in conjunction with other photographs, video, and audio, and in any medium (including but not limited to print and online formats) including but not limited to:

1. Display on the Grantee’s website and social media platforms.

2. Use in the Grantee’s portfolio and promotional materials.

If permission is not granted for online publication please note it below on the form.

I understand and agree to the following:

1. Ownership: I understand that the Grantee shall own all rights, title, and interest in and to the Images.

2. No Compensation: I understand and agree that I will receive no financial or other compensation for the use of the Images.

3. Representations and Warranties: I represent and warrant that I have the full legal right and authority to grant the rights herein granted and that I am the legal guardian of any participating minors and have the authority to sign on their behalf.

4. Consent for Minors: I confirm that I am the parent or legal guardian of any minor(s) participating in the photography session and I hereby consent to their participation and the use of their likeness in the Images under the terms of this release.
